These Terms of Service ("Terms") are a binding agreement between you and Pro Vision Multimedia Enterprises, LLC governing your access to and use of the Pro Vision Multimedia Enterprises Training Division platform (the "Service"), including all courses, lessons, exam materials, downloadable resources, offline application, and certifications made available through rothsteincampbell.com or any successor domain. By creating an account, purchasing a course, or otherwise using the Service, you agree to these Terms, our Privacy Policy, our Refund Policy, and our Cookie Disclosure.
If you do not agree, do not create an account and do not use the Service.
You may create an account only if you are at least sixteen (16) years old. If you are under 18, you represent that you have permission from a parent or legal guardian who has read and agrees to these Terms on your behalf. We do not knowingly permit users under 16. If we learn of an account belonging to a user under 16, we will terminate it and delete the associated data.
You agree to (a) provide accurate, current, and complete information when creating your account; (b) maintain and promptly update that information; (c) keep your password confidential; (d) use only one account per person unless expressly authorized by us in writing; and (e) not permit any other person to use your account. You are responsible for all activity that occurs under your account.
We may suspend or terminate your account at any time for violation of these Terms, without refund where a violation is established. See Section 10 (Termination).
Subject to your compliance with these Terms and payment of any applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Service and the course content for your own individual learning. This license terminates automatically upon breach of these Terms.
All course lessons, exam questions, cheat sheets, checklists, videos, downloadable resources, and other materials made available through the Service (collectively, the "Content") remain the exclusive property of Pro Vision or our licensors. You receive no other rights except those expressly granted in these Terms.
You agree not to do any of the following:
All Content, trademarks, logos, service marks, trade names, and other proprietary rights associated with the Service are owned by or licensed to Pro Vision. Nothing in these Terms grants you any right to use any Pro Vision trademark, logo, domain name, or other distinctive brand feature without our prior written consent.
You retain ownership of any original materials you submit through the Service (for example, capstone photographs). By submitting materials for evaluation, you grant Pro Vision a limited, worldwide, royalty-free license to store, review, evaluate, and reproduce those materials solely for the purpose of grading, providing feedback, and (with your separate written consent) using them as anonymized examples in future course materials.
All fees are listed in United States Dollars (USD) and are exclusive of any applicable taxes, which are your responsibility unless required by law to be collected by us. Payment is processed by Stripe, Inc. and is subject to Stripe's terms of service and privacy policy. We do not store your full payment card details on our servers.
Prices are subject to change. Any price change will apply only to purchases made after the change takes effect. Once you have purchased a course, the price you paid remains fixed for that specific access grant.
Refunds are governed by our separate Refund Policy, which is incorporated into these Terms by reference. Any dispute regarding a refund must first be raised with us via email before initiating a chargeback with your card issuer or bank.
Certifications issued by Pro Vision reflect that, based on the information available to us at the time of issuance, you successfully completed the specified course of study and demonstrated the level of proficiency measured by our examination. Certifications are for personal, non-transferable recognition of your effort and are not a professional license or a substitute for professional credentialing (for example, PPA Certified Professional Photographer status).
Revocation. Pro Vision Multimedia Enterprises Training Division reserves the right to revoke any certification if, in its sole discretion, it determines the exam was completed dishonestly, the certificate was misrepresented, or these Terms of Service were violated. Revocation is final, non-appealable, and the certificate's public verification URL will display the revocation together with a brief reason. You waive any claim against us arising out of a good-faith revocation.
Exam attempts are monitored using automated integrity checks including, without limitation, per-question response timing, device fingerprinting, and anomaly detection. Attempts that are flagged for suspected dishonesty are subject to human review and may result in a failing grade, account suspension, or revocation of prior certifications. By taking an exam through the Service you consent to this monitoring.
You may close your account at any time by emailing us at the address in the header of these Terms and requesting deletion. See our Privacy Policy for how we handle account data on deletion.
We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms, if required by law, or to protect the safety or integrity of the Service. If we terminate your account for cause, you are not entitled to a refund of any fees paid. Sections 5, 8, 11, 12, 13, 14, 15, and 16 survive termination.
THE SERVICE AND THE CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE CONTENT WILL PRODUCE ANY PARTICULAR OUTCOME FOR YOU, INCLUDING WITHOUT LIMITATION ANY PARTICULAR LEVEL OF PROFESSIONAL COMPETENCE OR INCOME.
The Service is intended for educational purposes only. Nothing in the Content should be construed as personal, business, or professional advice.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL PRO VISION, ITS OFFICERS, EMPLOYEES, AGENTS, LICENSORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE SERVICE, THE CONTENT, OR THESE TERMS, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS (US $100.00), WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In those jurisdictions our liability is limited to the smallest extent permitted by law.
You agree to defend, indemnify, and hold harmless Pro Vision Multimedia Enterprises, LLC, its affiliates, officers, employees, and agents from and against any claim, demand, loss, liability, damage, or expense, including reasonable attorneys' fees, arising out of or related to (a) your use or misuse of the Service, (b) your violation of these Terms, (c) your violation of any law or the rights of any third party, or (d) any content you submit to the Service.
We respect intellectual property rights. If you believe any Content on the Service infringes your copyright, please send a written notice to rothstein@pvme.org containing the information required by 17 U.S.C. ยง 512(c)(3): (i) a physical or electronic signature of the copyright owner or authorized agent; (ii) identification of the copyrighted work claimed to have been infringed; (iii) identification of the material claimed to be infringing and information reasonably sufficient to locate it; (iv) your contact information; (v) a statement of good-faith belief that the use is not authorized; and (vi) a statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the owner.
These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict-of-law principles.
Informal resolution first. Before filing any formal claim, you agree to first contact us at rothstein@pvme.org to attempt to resolve the dispute informally. We will attempt to resolve any dispute within thirty (30) days of receipt of notice.
Binding arbitration. Any dispute not resolved informally will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, in Virginia, United States. Judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction. You and Pro Vision each waive the right to a trial by jury.
Class action waiver. You agree that any dispute will be brought in your individual capacity and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.
Small claims exception. Either party may bring an individual action in small claims court for disputes within the jurisdictional limits of that court.
We may update these Terms from time to time. If we make material changes, we will notify you by email (to the address on file) or by a prominent notice on the Service before the changes take effect. Your continued use of the Service after the effective date of the updated Terms constitutes acceptance. If you do not agree to the updated Terms, your only remedy is to stop using the Service and close your account.
Entire agreement. These Terms, together with the Privacy Policy, Refund Policy, and Cookie Disclosure, constitute the entire agreement between you and Pro Vision regarding the Service and supersede all prior agreements.
Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force.
No waiver. Our failure to enforce any right or provision will not constitute a waiver of that right or provision.
Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
Force majeure. We will not be liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, pandemics, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
